These Terms of Service ("Terms") govern your access to and use of CareForge (the "Service"), operated by [CONFIRM: legal entity name, e.g. "Jane Smith d/b/a CareForge" or an LLC/corp name] ("CareForge," "we," "us," or "our"). By creating an account, starting a free trial, or otherwise using the Service, you ("you," "your," or the "Operator") agree to these Terms. If you do not agree, do not use the Service.
CareForge is a software platform that lets you build and run a childcare business's operations: a parent-facing website, enrollment and family records, tuition billing, attendance, document signing, and related tools. CareForge is a software provider only. We are not a party to, and have no responsibility for, the childcare services or tuition arrangements between you and the families you serve. You are solely responsible for your business, your licensing, your tuition and enrollment agreements, and compliance with all childcare regulations and laws that apply to your business.
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at [CONFIRM: support/legal contact email] if you suspect unauthorized access.
New plans that include a free trial require a valid payment card before the trial begins. Your card is not charged during the trial. At the end of the 3-day trial period, unless you cancel before it ends, your card is automatically charged the then-current monthly price of the plan you selected, and your subscription begins. The exact price and the exact date of that first charge are shown to you, and you must affirmatively agree to them, before your trial starts.
Paid subscriptions are billed monthly in advance on your subscription's billing date, using the payment method on file, and automatically renew each month until cancelled. Prices are shown to you at signup and in your dashboard's Billing & Plan screen; we will make reasonable efforts to notify you of price changes before they take effect. Applicable taxes may be added where required by law.
CareForge's subscription charges are separate from, and unrelated to, any tuition payments families make to you — those go directly to your own Stripe (or other) account, and CareForge never holds or has access to your families' funds.
You may cancel your subscription at any time, self-serve, from Billing & Plan in your dashboard — no need to contact anyone. If you cancel during your free trial, you will not be charged. If you cancel an active paid subscription, cancellation takes effect at the end of your current billing period, and you will not be charged again after that period ends; access continues until then.
Charges that have already been processed after your trial converts to a paid subscription are generally non-refundable, including for partial billing periods. We may, at our sole discretion, issue a full or partial refund in specific circumstances (for example, a billing error on our part). Refund requests can be sent to [CONFIRM: support/legal contact email]; approval is not guaranteed.
You agree not to: use the Service for any unlawful purpose; misrepresent your business or identity; attempt to bypass, disable, or interfere with the security or normal operation of the Service; resell or provide the Service to third parties as your own SaaS product; upload content you do not have the right to use; or use the Service to send unsolicited communications in violation of applicable law (including SMS/email marketing laws).
You retain ownership of your business content (branding, program details, family and child records, blog posts, and similar data you create or upload). Every operator's data is technically isolated from every other operator's data. We access your account only to provide support you request, to maintain the Service, or as required by law. See our handling of payment data in Section 9.
The Service integrates with third-party providers you may choose to connect, including Stripe (payments), SignWell (document signing), and email delivery providers. Your use of those providers is subject to their own terms and privacy policies. CareForge is not responsible for the acts or omissions of third-party providers.
CareForge and its software, design, and branding are owned by us and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding beyond what is needed to use the Service as intended.
We may suspend or terminate your account for violation of these Terms, non-payment, fraudulent or abusive activity, or as required by law. You may stop using the Service and cancel your subscription at any time as described in Section 5. Upon termination, your right to access the Service ends; we will make reasonable efforts to allow you to export your data beforehand where feasible.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure at all times.
To the maximum extent permitted by law, CareForge and its owners/operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [CONFIRM: liability cap period, e.g. "12 months"] preceding the claim.
